Terms & Conditions

These Terms & Conditions (“Terms”) are a binding agreement between you and Petaleads Ltd (“LuckAndSpin”, “we”, “us” or “our”) and govern your access to and use of luckandspin.com and our related games, apps and services (the “Platform”). By accessing or using the Platform, you confirm that you have read, understood and agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Platform.

1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction, if higher) and have the legal capacity to enter into these Terms. The Platform is intended solely for entertainment and is not available where free-to-play social gaming or sweepstakes promotions are prohibited. You are responsible for ensuring that your use of the Platform is lawful where you live. We may refuse, restrict or verify accounts, and may request proof of age and identity at any time. The Platform is not available to residents of the following excluded territories: the United Kingdom, the United States (including the states of Washington, Idaho, Michigan, Montana and Nevada), and any other jurisdiction where free-to-play social casino or sweepstakes gaming is prohibited by law.

2. Nature of the service — social play, not gambling

LuckAndSpin is a free-to-play social casino and sweepstakes entertainment platform. The games are provided for entertainment purposes only. No real money is required to play, and we do not offer real-money gambling. Virtual currency, coins and in-game items have no monetary value, cannot be redeemed or exchanged for cash, and are licensed to you, not sold. Practising or succeeding at social casino games does not imply that you would experience similar success at any form of real-money gambling. Where we run a promotional sweepstakes feature, participation is always free and no purchase is necessary (see Section 5).

3. Your account

To access certain features you must register an account. You agree to provide accurate and complete information, to keep it up to date, and to keep your login credentials confidential. You are responsible for all activity that occurs under your account. You may hold only one account unless we expressly permit otherwise. Notify us immediately at support@luckandspin.com if you suspect any unauthorised use of your account.

4. Virtual currency and items

The Platform uses virtual currency and items (for example, “Coins” for standard play and, where offered, promotional entries used in sweepstakes play). Virtual currency and items: have no real-world monetary value; cannot be transferred, sold, or exchanged for cash except as expressly provided in official sweepstakes rules; and are provided under a limited, personal, revocable, non-transferable licence. When you “buy” Coins you are buying a licence to use them within the Platform, not the Coins themselves. We may create, manage, modify, price, expire or remove virtual currency and items at any time, and unused balances may be forfeited on account closure as permitted by law.

5. Sweepstakes and promotional play — no purchase necessary

From time to time we may offer sweepstakes promotions. NO PURCHASE IS NECESSARY TO ENTER OR WIN, and a purchase will not improve your chances of winning. A free method of entry is always available (for example a daily free bonus or a postal/AMOE request) as set out in the applicable official sweepstakes rules. All sweepstakes are subject to those official rules, which prevail over these Terms in the event of a conflict, and to eligibility, verification and minimum redemption requirements. Sweepstakes are void where prohibited. Winners are solely responsible for any taxes and for providing accurate redemption details. We reserve the right to disqualify entries obtained through fraud, automation or breach of these Terms.

6. Purchases and payments

Prices for virtual items are shown at the point of purchase and may include applicable taxes. By making a purchase you authorise us or our payment processor to charge your chosen payment method. Virtual items are digital content delivered immediately, so, to the extent permitted by law, all sales are final and non-refundable once delivered; where you have a statutory right of withdrawal, you acknowledge that it may be lost once delivery of the digital content begins with your consent. If you initiate a chargeback or payment dispute, we may suspend or close your account and revoke associated virtual items.

7. Acceptable use

When using the Platform you agree not to:

  • Use bots, scripts, automation, exploits or any method to gain an unfair advantage or interfere with normal play.
  • Create multiple or fake accounts, or access another user’s account.
  • Engage in fraud, money laundering, or any unlawful activity, or use the Platform in breach of applicable law.
  • Reverse engineer, decompile, copy, modify or create derivative works from the Platform except as permitted by law.
  • Upload harmful code, harvest data, or attempt to breach the security of the Platform.
  • Harass, threaten, defame or abuse other users or our staff, or post unlawful, offensive or infringing content.

8. User content

If the Platform lets you submit content (such as a username, chat messages or profile information), you retain ownership of it but grant us a worldwide, non-exclusive, royalty-free licence to use, host, display and distribute it in connection with operating and promoting the Platform. You are responsible for the content you submit and confirm you have the rights to submit it. We may remove content that breaches these Terms or applicable law.

9. Intellectual property

The Platform and all software, games, graphics, text, logos, trademarks and other materials are owned by or licensed to LuckAndSpin and are protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the Platform for personal, non-commercial entertainment, subject to these Terms. All rights not expressly granted are reserved.

10. Third-party services

The Platform may be offered through, or interact with, third-party services such as app stores and social networks. Your use of those services is governed by their terms and privacy policies, and we are not responsible for them.

11. Suspension and termination

We may suspend or terminate your access to the Platform, and remove or revoke virtual currency and items, if you breach these Terms, if we are required to by law, or to protect the Platform or other users. You may stop using the Platform and close your account at any time by contacting support@luckandspin.com. On termination, your right to use the Platform ends and any virtual currency or items may be forfeited to the extent permitted by law.

12. Disclaimers

The Platform is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Platform will be uninterrupted, error-free or secure, or that defects will be corrected. Nothing in these Terms excludes any warranty or right that cannot be excluded under applicable law.

13. Limitation of liability

To the fullest extent permitted by law, LuckAndSpin and its officers, employees and partners will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill, arising out of or relating to your use of the Platform. Our total liability for any claim relating to the Platform will not exceed the greater of the amount you paid us in the 12 months before the claim or USD 100. Nothing in these Terms limits liability that cannot be limited under applicable law, and consumers retain all mandatory statutory rights.

14. Indemnification

You agree to indemnify and hold harmless LuckAndSpin and its affiliates from any claims, losses, liabilities and expenses (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Platform, or your violation of any law or third-party right.

15. Governing law and disputes

These Terms are governed by the laws of [Petaleads’ country of incorporation — to be completed], without regard to its conflict-of-laws rules. Before starting formal proceedings, please contact us so we can try to resolve the matter informally. Any dispute that cannot be resolved will be subject to the exclusive jurisdiction of the competent courts of the place where Petaleads Ltd has its registered office. Consumers in the EEA and UK keep the benefit of any mandatory protections of their home country and may access the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

16. Changes to these Terms

We may update these Terms from time to time. When we make material changes we will update the “Last updated” date and provide reasonable notice. Your continued use of the Platform after changes take effect means you accept the revised Terms.

17. General

If any provision of these Terms is found unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a corporate transaction. These Terms, together with the Privacy Policy and any official sweepstakes rules, are the entire agreement between you and us regarding the Platform.
